States in Flux

A 2005 Supreme Court decision has resulted in states revisiting their alcohol sales laws – specifically how they regulate online, phone and mail order wine sales. Nearly every state in America has a lawsuit or legislation pending that would weaken the ability of officials to prevent underage alcohol access. Most states currently are considering allowing consumers to buy wine over the Internet and through other unaccountable sales that do not include a face-to-face transaction. But lawyers for the wine industry recently revealed their true intent, saying that beer and liquor distribution laws now also are suspect.

A 2006 audit of states confirms that even though the majority of states are moving to increase online alcohol sales, ONLY FIVE report they have ever done an online compliance check to see if minors are breaking the law to obtain alcohol – and in every one of those five cases, state laws were broken.
